(Aalto 2026) BinaryTech utilises and puts to work new materialist metaphysics and critical posthuman thought in practice. BinaryTech is based on Karen Barad’s agential realist interpretation of new materialist thought (Barad, 2007) and on Nordic Feminist legal studies. BinaryTech combines structures with performativity and enables an analytical practice that considers matter in its physicality alongside language and combines them in a form of material-discursive performativity that does not neglect societal power structures but places them as part of legal subject formation. Binaries are power techniques which create hierarchies that are made visible as the product of using BinaryTech framework as an analytical practice.

How is BinaryTech onto-epistemological?

In Barad’s agential realism onto-epistemology means that ontology (the nature of being/reality) and epistemology (the nature of knowledge) are fundamentally inseparable (Anumah, 2025; Barad 2007) BinaryTech functions as an onto-epistemological practice because:

The observer and the observed are entangled: Within BinaryTech framework, the legal researcher, the method of observation, the law itself, and the legal subject are not predetermined separable entities. The act of observing (BinaryTech as a practice) inherently co-constitutes the reality of the phenomenon being studied (Aalto 2026, Aalto & Tuominen 2025)

Material-discursive reality: It treats legal definitions not just as abstract language, but as material forces that physically modulate bodies, spaces, and everyday legal statuses (e.g., how the sex/gender binary impacts intersex individuals or non-heterosexual legal subject formation). (Aalto 2026, Aalto & Tuomine 2025, Aalto 2024)

Rejection of A Priori Dichotomies: Instead of accepting fixed, pre-existing categories like ”male/female” or ”subject/object” as universal truths, BinaryTech acts as an analytical apparatus to trace how these boundaries are legally and materially enacted. (Aalto & Tuominen 2025) Binaries are productive.

References

Aalto, Juho (2026) BinaryTech: On the Development of a New Materialist Method, Annales Universitatis Aboensis

Aalto, Juho (2024) ”Binarytech in Motion: The Sexgender at the European Court of Human Rights”, Leiden Journal of International Law

Aalto, Juho & Tuominen, Iiris (2025) ”Binarytech in Motion: Intersex Persons in the Binary Lawscape”, Law and Critique

Anumah, Peace (2025) ”Axio-Onto-Epistemology in Systemic Practice”, Murmurations: Journal of Transformative Systemic Practice

Barad, Karen (2007) Meeting the Universe Halfway, Duke University Press

Briefly BinaryTech is an onto-epistemological framework and practice, if you like.
